Mediating Pro Se Family Law Disputes:  Parts 1 & 2

Parties to a mediation deserve to understand the mediation process and the mediator’s job in that process. Pro se parties arrive at the mediation with pre-conceived notions of the law, which need to be addressed by the mediator in a mindful manner while not giving legal advice. This presentation will be a discussion of the Ethical Guidelines for Mediators, promulgated by the ADR Section of the State Bar of Texas and adopted by the Texas Supreme Court in 2011. The TMCA Standards of Practice and Code of Ethics will also be explored. Included in these ethical considerations will be questions regarding the appropriateness of the matter for mediation, the impartiality of the mediator, the role of advice from professionals outside the mediation, a party’s ability to meaningfully participate in the mediation process, the enforceability of mediated settlement agreements, and drafting settlement agreements.

Experienced trial attorney and TMCA Credentialed Distinguished Mediator, John Palmer serves as a mediator and neutral in probate, family, general civil litigation, personal injury, and employer/employee disputes at the state and federal court levels. He is currently Chair of TMCA, Past Chair of the ADR Section of the State Bar of Texas, and Past President of TAM. He has been honored with the Justice Frank G. Evans Award by the ADR Section of the State Bar, the Susanne C. Adams Award by TAM, and the Outstanding Credentialed Mediator Award by TMCA.

Attendees questions are welcome and encouraged.

Attend 1 session for 1 hour of CE/MCLE, including 1 hour of ethics. Attend both sessions for 2 hours of CE/MCLE, including 2 hours of ethics.*

Registration is free for AMA Members/$15 for non-members. Attorneys who wish to receive Texas MCLE credit are asked to pay a $5 fee to offset the cost of MCLE sponsorship.
